GENERAL TERMS AND CONDITIONS OF SALE


TICKETING FOR « HELLFEST OPEN AIR FESTIVAL »

Hellfest Productions is a non-profit organization under the French law of 1901, which organizes the Hellfest Open Air Festival of extreme music each June in Clisson (44), as well as satellite events throughout the year.

The dates for the Event are:

  • Hellfest Open Air Festival from June 19 to June 22, 2025

Through its website https://hellfest.fr/, this ticketing service is organized, directed, and controlled by HELLFEST PRODUCTIONS, a non-profit organization under the French law of 1901, registered with INSEE under SIREN number 488 296 609, located at 22 Avenue de la Caillerie – BP 19206 – 44192 Clisson cedex (hereinafter referred to as "the Organizer"). This ticketing service is conducted in partnership with SAS WEEZEVENT, a simplified joint-stock company with a capital of €72,21200, registered with the Paris Trade and Companies Register under number 503 715 401 00017, with headquarters at 14 Rue de l’Est – 21000 Dijon, France.

These general conditions (hereinafter referred to as “T&Cs”) were updated and posted online on June 26, 2023. Please note that these T&Cs apply solely to the act of ticket sales and the legal consequences arising from the purchase of an Access Title for the “HELLFEST OPEN AIR FESTIVAL,” regardless of the sales channel used.

Festival-goers are requested to carefully read all these T&Cs before ordering an Access Title for the “HELLFEST OPEN AIR FESTIVAL.”

ACCEPTANCE OF THE T&Cs

By placing an order with payment obligation for one of the Access Titles for the “HELLFEST OPEN AIR FESTIVAL,” the festival-goer automatically agrees to the provisions described below, as they will need to click the button “I have read and accept the T&Cs as well as the privacy statement” at the end of the order process.

The festival-goer acknowledges they have the legal capacity to commit to these T&Cs. In the event of refusal of the T&Cs by the festival-goer, they will not be able to order the Access Titles offered by the Organizer.

Unless proven otherwise, the data recorded by the Organizer and/or its ticketing provider constitutes proof of the transactions made by the festival-goer on the festival’s website https://hellfest.fr/. The Organizer reserves the right to adapt or modify these T&Cs at any time. In the event of modification, the T&Cs applicable to any Order or Pre-order will be those published on the Site at the time of ordering.


1. SPECIFIC PROVISIONS REGARDING ACCESS TITLES

1.1/ Marketing of the Access Title
The Organizer sets the number of Access Titles available for the Event. Sales of Access Titles are subject to availability per pricing category.

The price, date, and time stated on the Event’s sales page via the website https://tickets.hellfest.fr/ should be verified by the festival-goer before making a payment to ensure it matches the Access Title they seek. No claims will be accepted if the festival-goer selects the wrong Access Title or cannot purchase the desired Access Title due to availability when they access the sale. No ticket will be included in the order confirmation email; it can be downloaded one (1) month before the event through the Order Management Module.

1.2/ Price and Rates for Access Titles
It should be noted that no Access Title will be sent during the sale of the 4-day Passes; the order confirmation serves as proof.

All Access Titles prices are quoted in euros, including all taxes, on the website https://tickets.hellfest.fr/ and are displayed on the front of the Access Title. Prices include booking and handling fees (details available from SAS WEEZEVENT, the beneficiary of these fees). They are determined by the Organizer and SAS WEEZEVENT, depending on the category of the seats they provide access to. Prices can be modified at any time by the Organizer.

However, the updated and applicable price at the time of purchase is the one listed in the order summary and in the order confirmation email. The Access Title remains the property of the Organizer until full payment is received, and access to the event is only guaranteed upon complete payment. Prices do not include any customs duties or local taxes that may be applicable outside the European Union or in overseas territories. These charges are the customer’s responsibility, including the declaration and payment to the relevant authorities.

Purchasing the option to mail the wristband to the home must be completed for each ticket at the time of purchase, and any associated fees will be added to the total order amount.

1.3/ Maximum Number of Access Titles
The total number of tickets per person during online sales cannot exceed two (2) tickets per rate, as determined by the Organizer and indicated at the time of purchase. In the event of alternative sales, this number may be limited to one (1) per rate.

On-site, at the event entrance, one adult may purchase a single Half-Price Ticket. A person cannot circumvent this rule through multiple spaced purchases or by using multiple email addresses linked to the same account holder, whether individual or corporate, or by using software designed to bypass this rule. Ticket purchases for the event occur in real-time based on availability and the number of places set by the Organizer.

1.4/ On-site Sales and Reduced Rates
As the festival is marked “sold-out,” full-price ticket sales will not be available on-site on the day of the Event. However, adults with a valid Access Title may purchase a reduced-rate Access Title for a minor in their care. A minor aged six (6) to under seventeen (17) years is eligible for half-price. The conditions for reduced-rate access are outlined in Article 4.2 and must be consulted. No other reduced rates are available (student, disability, etc.).

The Organizer will provide a ticket resale booth at the event entrance for those wishing to resell their ticket securely.

1.5/ Easy Camp
Sales of accommodation solutions at Easy Camp will be announced in 2025 on the official festival website. It is not possible to enter Easy Camp with an Easy Camp ticket without having a 4-day Pass for the HELLFEST OPEN AIR FESTIVAL. Purchasing a ticket for Easy Camp grants access to the chosen accommodation for a duration of five (5) nights; it is not possible to reduce this duration or request a pro-rata payment. For security reasons in this reserved area, the initial purchaser must provide the names of all individuals staying in their accommodation at the time of purchase. The initial purchaser who paid for the order must present themselves at Easy Camp on the first day with their entry ticket and identification to retrieve their assigned accommodation. A security deposit will be required upon check-in, which will be deducted from a Cashless account via their wristband. The Cashless account can be recharged online at any time or at a bank on the festival site. To recover this security deposit, the depositor must be physically present during the check-out inspection of the accommodation. If the depositor is unable to be present during the check-out inspection, they must write to [email protected] before July 6, 2025 (midnight), providing all their contact details and the assigned accommodation number, and express their wish for the return of their security deposit. Any damages noted during the check-out inspection will be deducted from the deposit. This document will be signed by the initial purchaser, and in their absence, it will be deemed accepted without contestation. In addition to the accommodation price, a tourist tax will be collected, which will be paid to the Mixed Union of SCoT and the Pays du Vignoble Nantais. This tax is calculated based on the category of accommodation and the number of people staying, per night for a total of five (5) nights. The entry ticket for Easy Camp can be resold until June 12, 2025 (this date may change) on the website https://tickets.hellfest.fr/ and only through this channel.


2. PAYMENT & ORDER VALIDATION & DELIVERY


2.1/ General Provisions
The Organizer reserves the right to limit the distribution channels for its Access Titles.

All orders, regardless of where they are placed, are payable in euros. Validating the order obliges the festival-goer to pay the price indicated in the total amount of the cart.

2.2/ Purchase Process
Ordering an Access Title for the “HELLFEST OPEN AIR FESTIVAL” will result in the issuance of an e-ticket, per these T&Cs, allowing access to the event.

The steps to order an e-ticket on the website https://tickets.hellfest.fr/ are as follows:

  • Selection of the desired date, subject to actual availability and, where applicable, category and/or rate;
  • Input of the participant's personal information (for informational purposes only, this will appear on the ticket);
  • Input of the primary purchaser's personal information, who will be the sole contact for the Organizer;
  • For Easy Camp only: name of all individuals staying in the accommodation;
  • Selection of paid options for each ticket (e.g., Wristband-at-home option);
  • Order summary, listing essential details of the ordered event(s) and the absence of a right of withdrawal;
  • Acceptance of the T&Cs of HELLFEST PRODUCTIONS, the T&Cs of SAS WEEZEVENT, and various privacy policies by checking the opt-in box;
  • Creation of a shopping cart and activation of the “NEXT” button with a payment obligation;
  • Payment for the order, with a breakdown of accepted payment methods and bank verification code, if requested;
  • Option to print the order;
  • Receipt of a confirmation email with the details listed in the order summary and payment information.

This confirmation email confirms the conclusion of the contract and is sent within a maximum of forty-eight (48) hours after payment is accepted. After the purchase is confirmed, it is final and cannot be exchanged or refunded.

The Organizer also reserves the right to refund any order from a festival-goer who has an ongoing dispute over a prior order and/or who did not comply with the conditions stated during the purchase process.

2.3/ Secured Payment
The festival-goer’s bank account, through the chosen payment method, will be debited the total order amount upon final validation of the transaction. A payment receipt will be accessible to the festival-goer after the transaction on the order confirmation page and by email within forty-eight (48) hours.

If the festival-goer does not complete the purchase on the Organizer’s website—even if they confirm payment with their bank, such as with 3D Secure—the order will not be validated or debited, and no confirmation email will be sent.

Payments for Access Titles on the website https://www.hellfest.fr/ can only be made using the payment methods specified at the time of purchase: VISA and Mastercard.

Electronic payments made for transactions on the website are secured using SSL (Secure Sockets Layer) encryption, and data is transmitted to a banking server responsible for processing and verifying the payment without any intermediary access.

During payment, the festival-goer is redirected to the secure interface of the payment provider, SAS WEEZEVENT, which may add an additional security layer to the transaction with 3D Secure. If the festival-goer validates payment through their bank but does not complete the purchase on the Weezevent platform, the transaction will be canceled, and no order confirmation will be received.

2.3-1/ Delivery, Responsibility, and Dispute
Order confirmation results in an order confirmation email, which includes an order number needed for access to the Order Management Module. No tickets will initially be sent by email or postal mail.

For orders with the wristband delivery option, the wristband will be delivered to the festival-goer's specified address, as long as it is correctly entered. If the address is incorrect, the festival-goer consciously decides not to receive the wristband, with no refund or dispute possible.

The festival-goer must ensure the accuracy and completeness of the required information provided. If an error prevents the wristband from being received, it will be returned to the sender, and the festival-goer will no longer be entitled to its receipt. No refund can be issued.

2.3-2/ The Wristband
Festival-goers who have opted for wristband delivery will receive instructions on how to obtain their wristband one month before the event at https://www.hellfest.fr/. This delivery option applies exclusively to “4-day festival-goer Passes” and not to VIP or other pass types. If the required information is incomplete or incorrectly entered, no wristband will be sent, and no refund will be possible.

Wristbands for 4-day Passes will be shipped between May and June 2025 (subject to change, with updates provided by email). Festival-goers can input or update their details during the specified data collection period. Once this period ends, no further changes will be possible.

If a festival-goer does not receive their wristband, they must bring their Access Title to the festival entrance and visit the on-site customer service to receive a new wristband. Any Cashless credit preloaded on the original wristband will be transferred. Once a wristband has been used to enter the festival, no customer service intervention will be available.

The Organizer is not liable for any lost, stolen, or damaged wristbands prior to use. They also reserve the right to deny entry to festival-goers with an invalidated Access Title, an unauthorized wristband, or any other case of non-compliance with these terms, without possibility of dispute.


3. PROCESSING OF PERSONAL DATA

3.1/ Collection of Personal Data
The Organizer is the data controller. The Organizer may collect certain personal information from the festival-goer during the order process, including (but not limited to) name, email address, mobile phone number, postal address, postal code, city, title, and date of birth.

3.2/ Purposes of Data Processing
Festival-goer information is essential for order processing and customer relationship management. This data is also retained for security purposes and to fulfill legal and regulatory data retention obligations.

The data will be used for managing and tracking the festival-goer’s order and for communicating in case of an event postponement or cancellation.

By providing their data, the festival-goer agrees to allow the Organizer to inform them of any changes that could impact the event, such as cancellation, postponement, or modifications to the venue, as well as to communicate the contract terms up until the event date.

3.3/ Data Recipients
In the course of order processing, certain entities contractually affiliated with the Organizer may access the data (e.g., event organizers, external points of sale, or technical delivery service providers). These entities are bound to strict confidentiality regarding this data, and no unauthorized marketing is permitted.

3.4/ Data Retention Period
Personal data will be retained for the duration necessary to fulfill the purpose for which it was collected, subject to legal obligations requiring the Organizer and its providers to retain data for accountability purposes. HELLFEST PRODUCTIONS will store festival-goer data for a minimum of three (3) years, starting from the date of purchase or the last contact with the Organizer.

After this period, festival-goer data will be archived or deleted in accordance with applicable legal retention obligations.

3.5/ Festival-Goer's Consent
The festival-goer can choose to allow the Organizer to send them newsletters and essential information for order processing via SMS or email.

If the festival-goer does not wish to receive further communications from the Organizer or its partners after the event, they may send an email to Hellfest Productions – GDPR - 4 La Feuillée – 85610 Cugand – France.

3.6/ Rights of Access, Rectification, and Objection
In accordance with the EU General Data Protection Regulation (GDPR), the festival-goer has the right to access, correct, or delete their data, subject to applicable legal provisions.

They may exercise these rights by contacting Hellfest Productions – GDPR - 4 La Feuillée – 85610 Cugand – France. Requests must be signed and accompanied by a copy of an official ID with the festival-goer’s signature, as well as the address to which the response should be sent.

Data will be retained as necessary to fulfill the ticket's purpose and cannot be deleted before the event for which it was collected, for obvious reasons.


4. ACCESS & CONTROL OF ACCESS TITLES

4.1/ Access to the Event
Access to the Event is granted by presenting a valid e-ticket on a smartphone or the wristband received at home.

If an e-ticket is lost or inaccessible, the festival-goer must visit https://tickets.hellfest.fr/ to access their order (using the order number). For technical issues or unresolved questions, they may contact Customer Service at [email protected]. The Organizer reserves the right to deny a duplicate ticket without explanation.

If a ticket or wristband with Cashless credit is lost prior to festival entry, the ticket holder must email [email protected] from the email used for purchase, including their details and order number, to request the detachment of the Access Title from their Cashless account. On the day of the festival, they should bring their Access Title to be issued a new wristband, with the Cashless credit from their online account transferred to it.

Every festival-goer must carry a valid Access Title and keep it until the end of the event, even if wearing a wristband. Each Access Title has a unique QR code and cannot be used multiple times for entry on the same day. It is not possible to claim a wristband by presenting an Access Title already paired with another wristband.

The event starts at the time indicated on the website https://hellfest.fr/ and the app, except in cases of force majeure. It is advised to arrive at least two (2) hours prior to the event start time. Scanning for entry is open from 9:00 AM to midnight, Friday through Sunday. Entry will be refused to anyone arriving between midnight and 2:00 AM (the next day), even if the Access Title is valid.

Refunds will not be issued for festival-goers who cannot enter during the control hours on their Access Title.

4.2/ Access for Minors and Reduced Rates
HELLFEST PRODUCTIONS reminds attendees of the nature of the event (large areas, crowds, high noise levels) and does not encourage the presence of minors. They strongly advise providing proper hearing protection and any necessary accessories, especially for minors.

The festival does not allow entry to children under six (6) years old.

If a minor is between six (6) and sixteen (16) years old, a half-price Access Title can be purchased on-site by scanning the QR code at the entrance, and payment can only be made by VISA or Mastercard. An adult may only purchase one half-price ticket per minor. The adult purchasing the minor’s half-price ticket must present the minor in person at the “Ticketing” booth with their own valid Full-Price Access Title, ID, and either the child’s ID or a family record book proving the relationship.

The Organizer reserves the right to refuse or refund any request that does not meet these conditions.

4.3/ Access Title and Wristband Checks
The Organizer will use QR code scanners to verify Access Titles upon entry to the event. Each purchase will generate an Access Title with a unique QR code, and each Access Title will be individually verified upon entry, leading to the corresponding wristband being issued. The first person to present the Access Title is deemed the rightful owner of the wristband, regardless of the name on the ticket.

Festival-goers must be able to present their Access Title upon request while wearing their wristband. If their wristband fails verification, they must provide proof of their legitimacy for entry. Festival-goers whose legitimacy is questioned or suspected of fraud will be required to leave.

4.4/ Identity and Security Checks
The Organizer reserves the right to check the festival-goer’s identity at the venue entrance or within the event area. The festival-goer must therefore carry a valid, government-issued photo ID.

Attendees may also be subject to security searches upon entry and at any time during the Event. Access will be denied to anyone refusing such measures, and their Access Title may be invalidated, or their wristband permanently removed. Even after receiving a wristband, festival-goers must keep their Access Title until the event concludes.

4.5/ Prohibited Items
For security reasons, it is strictly prohibited to bring weapons, explosives, flammable or volatile substances, bottles, containers such as water bottles, sharp or blunt objects, or any item that could be used as a projectile or pose danger. Political, ideological, religious, or advertising signs and banners are also prohibited.

Violators may be denied access, escorted out, and may face legal action.


5. USE AND VALIDITY OF ACCESS TITLES

5.1/ Validity of Access Titles and Wristbands
The Access Title is only valid for the event, date, time, and conditions specified on the Access Title itself. It must be retained until the end of the event. The wristband is likewise valid only for the event, date, time, and conditions specified on the Access Title that activated it. A festival-goer cannot gain access to the festival with an Access Title or wristband that does not match the event date.

5.2/ Resale of Access Titles and Wristbands
Each Access Title is personal and can only be resold in accordance with French Law No. 2012-348 of March 12, 2012, which regulates the resale of event tickets for sports and cultural events and prohibits unauthorized ticket resale, punishable by fines of up to €15,000, or €30,000 in case of repeat offenses.

Only the platform https://tickets.hellfest.fr/ is authorized to facilitate the official resale of second-hand tickets for the “HELLFEST OPEN AIR FESTIVAL” 2025 edition. It is strongly advised that each attendee has an Access Title under their own name, or, if not originally purchased through the official platform, that it be acquired through a private sale via https://tickets.hellfest.fr/. It is not recommended to purchase an Access Title from an unknown third party, whether online or offline, as it may not be genuine.

It is strictly forbidden to resell a wristband. The wristband is assigned to a specific festival-goer and grants access to the festival based on the activated Access Title. If a wristband is stolen, the festival-goer should contact [email protected] to detach the ticket from the Cashless account, preserving any preloaded credit and the Access Title associated with it.

5.3/ Reproduction of Access Titles 
It is prohibited to reproduce, duplicate, or counterfeit an Access Title or wristband in any manner. Unauthorized reproduction of Access Titles or wristbands is prohibited and will not grant any advantages.

The Organizer may refuse access if multiple copies of an e-ticket are detected, and access has already been granted to the holder of one of those copies. The Organizer is not required to verify the identity of the individual holding the e-ticket and may only admit the first person presenting it as the legitimate holder. In this case, any subsequent holder denied access will not receive a refund.

5.4/ Multiple Access Titles
A festival-goer may possess multiple Access Titles, and all must be presented the first time they enter the festival to receive all corresponding wristbands. The festival-goer should also inform control agents which Access Title has any preloaded Cashless credit. If an Access Title is forgotten or purchased after receiving a wristband, the festival-goer must go to the Customer Service counter or approach a control agent to modify access rights.

HELLFEST PRODUCTIONS reminds that reproducing or using counterfeit Access Titles is subject to criminal prosecution according to Articles 313-1 and 441-1 of the French Penal Code.


6. POSTPONEMENT, CANCELLATION, REFUNDS, AND OFFICIAL RESALE

6.1/ Scope
These terms regarding postponement, cancellation, and refunds apply to all Access Titles sold by the Organizer or through the official resale platform at https://tickets.hellfest.fr/. Per Article L. 221-28 of the French Consumer Code, event tickets do not grant the right to withdrawal.

Once purchased, Access Titles cannot be exchanged or refunded, except as outlined below, even if unused by the festival-goer.

The event may be postponed, partially or entirely canceled, due to technical, weather-related, security, health, or other reasons beyond the Organizer’s control.

6.2/ Event Postponement
In the event of postponement, the Access Title remains valid for the rescheduled date. Should the festival-goer prefer a refund, they may request it according to the procedures in section 6.5.

6.3/ Event Cancellation and Artistic Modifications  
If the Event is canceled, refund procedures will be communicated on the official website. Refunds will only be issued to the original purchaser who completed the order, not to attendees whose names appear on the tickets for informational purposes.

The Access Title is a purchase of a complete service, not for specific artists. Therefore, cancellations of particular artists do not entitle the festival-goer to a refund or damages.

For single-day passes, if the entire day is canceled, a full refund will be issued to the original purchaser. If 50% or more of the day’s events occur, no refund will be given. For 4-day passes, refunds will be prorated based on the number of days canceled, with each day valued at 25% of the total ticket price.

6.4/ Refund Procedures
Refund request conditions will be communicated to the festival-goer at the time of the postponement or cancellation of the entire “HELLFEST OPEN AIR FESTIVAL” edition. Dates will be announced on the official website https://tickets.hellfest.fr/.

Any refund request received after the exceptional refund period or not following the Organizer's indicated procedures will be considered invalid. Requests sent via email will also be invalid. Any request not meeting these criteria will be rejected.

Any tickets purchased outside of the official sales platform https://tickets.hellfest.fr/ are excluded from the online refund procedure. The festival-goer must contact the original seller directly to request a refund for their Access Title.

6.5/ Refund Amount
Only the price of the Access Title will be refunded, excluding management and rental fees retained by SAS WEEZEVENT. No ancillary fees (e.g., cross-selling options) will be refunded or compensated.

6.6/ Ticket Refund Option
During the purchase process, the festival-goer may select the Ticket Refund Option for each ticket they wish to insure against change of mind. This option is chargeable and must be paid for each ticket. From the day after purchase until May 12, 2025, the festival-goer may request a refund independently by entering their order number and the email used for purchase at https://tickets.hellfest.fr/gestion-commande.html  

The refund request must be validated and will be final. The refund will be processed within sixty (60) days (a non-contractual timeline) and will appear in the festival-goer’s bank account according to their own banking institution’s timelines. The festival-goer must follow this procedure for each ticket they wish to cancel for which they opted for the refund option. Refunds cannot be issued to third-party bank accounts.

6.7/ Official Resale
Each holder of an Access Title for the Event may resell it via their Order Management Module on https://tickets.hellfest.fr/. By logging in with the email used for purchase and the order number, and confirming the security link sent, the Access Title owner can rename it and/or click the resale option. A private sale link will be generated to send this offer to a friend and only to that person.

The original owner and potential secondary buyer may choose not to complete this private sale, and the Access Title will be available again thirty (30) minutes after sending in the Owner’s Order Management Module. The owner can then choose to list their Access Title publicly.

The secondary buyer may visit the resale module at https://tickets.hellfest.fr to purchase an Access Title if an original buyer has made it public. If no Access Titles are listed for public sale, the secondary buyer cannot purchase one.

It is possible to sign up for a waiting list by entering an email address on the resale module homepage. However, signing up does not guarantee obtaining an Access Title. The Organizer reserves the right to condition email notifications to those on the waiting list and is not liable for any missed notifications.

Once an Access Title is sold, it will automatically be removed from the original owner’s Order Management Module and will appear in the new owner's module, who may manage it as they wish. Options that were paid for by the new owner are based solely on their choices and cannot be transferred.

The seller cannot charge for management fees previously paid or any options they selected. The price for the 4-day Pass in 2025 is €339 including VAT, which is the amount the seller will receive. In the case of an initial purchase on the official Hellfest platform, the seller will be refunded to the card used for purchase. After the purchase, the refund will be requested within twenty-four (24) hours and will appear in the seller’s bank account according to their bank’s processing timelines. The secondary buyer will incur management fees of ten (10) percent of the ticket price, with no fees on options.

For internal organizational reasons, the Organizer reserves the right to terminate access to options at any time without prior notice.


7. RESPONSIBILITY

7.1/ Organizer's Responsibility
In accordance with Article L. 221-15 of the Consumer Code, the Organizer is responsible for the proper execution of obligations resulting from contracts concluded at a distance.

The Organizer declines all responsibility for any unavailability of the online ticketing service resulting from force majeure, including:

  • Any anomalies in the festival-goer’s computer equipment;
  • Unforeseeable, insurmountable events external to the Organizer’s will;
  • Unavailability of the internet network.

7.2/ No Responsibility for Loss or Theft of Access Titles
The Organizer is not liable for loss, theft, or unauthorized use of the Access Title purchased by the festival-goer. Moreover, the Organizer is not required to issue duplicates in the event of loss or theft of the Access Title.

7.3/ Responsibility of the Festival-Goer During the Event
The Organizer sets the rules specific to the event’s organization. These rules will be available on-site at the Event.

The festival-goer must strictly adhere to the Organizer’s regulations, failing which they may be denied access to the Event or expelled from the event without any right to claim a refund for the Access Title(s) purchased or any form of compensation.

The festival-goer also agrees to abide by the community conduct charter applicable to all areas within the Clisson Valley Communities.

The festival-goer must comply with current national health regulations and any health measures implemented by the Organizer, failing which they may be denied access or expelled from the event without a right to a refund.

The festival-goer is solely responsible for any fraudulent use of identity documents or health checks. Unless specifically authorized, the festival-goer is prohibited from taking photographs, filming, or recording the event for professional or commercial purposes in any manner.


8. CUSTOMER SERVICE, MEDIATION, DISPUTE RESOLUTION & APPLICABLE LAW

8.1/ Ticketing Support
If the official owner of a ticket order needs any information not available on the website or requires the Organizer’s intervention regarding their order, they can contact the Organizer’s customer service ([email protected]). They should write using the email associated with their order and provide as much information as possible (order number, name on the ticket, name of the purchaser, etc.) so that the customer service can respond effectively.

8.2/ Mediation
In case of a dispute, the festival-goer must first make a preliminary complaint and contact the Organizer via email at [email protected] or by registered letter with acknowledgment of receipt to HELLFEST PRODUCTIONS – 4 La Feuillée – 85610 CUGAND – France.

If the complaint is unsuccessful or there is no response from the Organizer within two (2) months, the festival-goer may submit the dispute regarding the purchase of their Access Title or the application of these T&Cs to a mediator who will attempt to resolve the issue amicably and independently.

Both parties to the contract are free to accept or refuse mediation, and they may also accept or refuse the solution proposed by the mediator.

8.3/ Dispute and Applicable Law
Sales of Access Titles by the Organizer are governed by French law. Failing an amicable agreement, any dispute arising under these T&Cs will fall under the exclusive jurisdiction of French courts.

The competent court will be that of the defendant's domicile (Article 42 of the Code of Civil Procedure) or that of the actual place of delivery or performance of the service (Article 46 of the Code of Civil Procedure).


9. MODIFICATION OF THE T&Cs BY THE ORGANIZER AND NULLITY

The Organizer reserves the right to modify these T&Cs, partially or wholly, at any time. The festival-goer is deemed to accept the current version of the T&Cs each time they connect to the Organizer's website https://tickets.hellfest.fr/ or when purchasing their Access Title.

If one or more clauses of these T&Cs are annulled or deemed invalid due to law, regulation, or final judicial decision, the remaining clauses will remain applicable and retain their full force and effect.


10. USE OF THE FESTIVAL-GOER'S IMAGE RIGHTS

By accepting these T&Cs, the festival-goer acknowledges that, in the event of filming or broadcasting (including video clips) of the Event on any digital, computer, or photographic medium, their image may be included.

By agreeing to these T&Cs, the festival-goer authorizes the Organizer and its agents (including but not limited to audiovisual service providers, professional photographers, drone operators, and filmmakers) to reproduce their image captured in photographs for the promotion and communication of the “HELLFEST OPEN AIR FESTIVAL,” both within the festival area and at all locations identified as affiliated with the Event.

This authorization allows the Organizer and its agents to modify the original capture of the festival-goer's image in any way they see fit (including using, publishing, reproducing, adapting, or modifying it alone or in combination with other materials by any current or future means, methods, or techniques).

The festival-goer’s image may be used and exploited for commercial purposes (e.g., promoting commercial partners) or otherwise. By accepting these T&Cs, the festival-goer consents to the use of their image to promote and communicate about the “HELLFEST OPEN AIR FESTIVAL” in which they participated.
